By using this website or engaging Legacine's services, you confirm that you are at least 18 years of age, have legal capacity to enter into this Agreement, and agree to be bound by these Terms and Conditions.

Where you engage our services on behalf of a family or estate, you confirm that you are authorised to do so and to provide personal data relating to other family members.

3. Service description

Legacine provides archival, clerical, and organisational services for families managing estate documents and personal records. Our services are described in detail on our website and in the written service agreement issued before any work begins.

Legacine's services are archival and clerical only. We do not provide legal advice, financial advice, valuation services, interpretation of documents, or drafting of any kind. Any question requiring such expertise is referred to the appropriate qualified professional.

Services are available primarily in the Klang Valley, Malaysia. Enquiries from families based elsewhere in Malaysia are considered individually; travel arrangements and costs are agreed in writing before work begins.

4. Handling agreement

Before any Materials are collected, copied, or handled, Legacine and the Client will enter into a written Handling Agreement. This Agreement identifies the Materials in scope, the authorised recipients of any copies produced, the timeline for the work, and the method of return for original Materials.

No work will begin without a signed Handling Agreement. The Handling Agreement forms part of the overall Agreement between you and Legacine.

You confirm that you have the right to entrust the Materials to Legacine and to authorise the work described in the Handling Agreement.

6. Intellectual property

All original Materials remain the property of the Client or the estate throughout and after the engagement. Legacine holds no ownership over any document, photograph, or other item entrusted to us.

The finding aids, indexes, and written reports produced by Legacine are created for the Client's use. The Client is granted a non-exclusive right to use, copy, and share these outputs within their family and with their professional advisers.

Legacine retains copyright in its own methodologies, templates, and internal working documents, which are not delivered to the Client.

7. Payment terms

Fees for each service are stated in Malaysian Ringgit (RM) and are as follows at the date of this policy: Estate Document Inventory Session — RM 560; Family Records Archiving Project — RM 2,300; Household Records Stewardship — RM 4,650 per year. Current fees are confirmed in the written service agreement.

Payment terms are specified in the service agreement. A deposit may be required before work begins. The balance is due on completion of the work and handover of Materials and outputs.

Fees are not refundable after work has begun, except where Legacine is unable to complete the work as agreed through our own fault. In that case, a proportional refund reflecting work not yet done will be offered.

Payment may be made by bank transfer or other methods agreed in writing. Receipts are issued for all payments.

8. Confidentiality

Legacine treats all Materials and all information provided by Clients as strictly confidential. Materials are not shared with any third party except the authorised recipients named in the Handling Agreement.

Staff who access Materials do so only as necessary to perform the work agreed. No copies are retained by Legacine after handover to the Client, except as required by law.

9. Disclaimers

Legacine's services are archival and clerical. We do not represent that our work constitutes, replaces, or substitutes legal, financial, valuation, or any other regulated professional advice. Nothing in our finding aids, indexes, or referral lists should be relied on as legal or professional advice.

While we take care in handling Materials, we cannot be responsible for pre-existing damage or deterioration not disclosed at the time of collection. Condition is noted on receipt and reported in writing to the Client.

10. Limitation of liability

To the fullest extent permitted by Malaysian law, Legacine's total liability for any claim arising from or in connection with our services is limited to the fees paid by the Client for the specific service giving rise to the claim.

Legacine is not liable for indirect, consequential, or special damages, including loss of profit, loss of anticipated savings, or loss of opportunity.

11. Termination

Either party may terminate a service agreement by written notice. Where termination is initiated by the Client after work has begun, fees are payable for work completed to the date of termination. Materials will be returned to the Client within 14 days.

Where Legacine terminates for reasons outside our control (such as inability to access Materials), we will return all Materials and provide a written explanation. Any fees paid in excess of the work completed will be refunded.

12. Dispute resolution

In the first instance, disputes should be raised with us in writing at [email protected]. We will acknowledge receipt within 5 working days and aim to resolve the matter within 30 days.

Where a dispute cannot be resolved informally, it will be referred to mediation before any court proceedings are commenced. Both parties agree to participate in good faith mediation.

These Terms and Conditions are governed by the laws of Malaysia. The parties submit to the non-exclusive jurisdiction of the courts of Malaysia.

13. General provisions

These Terms and Conditions, together with the Handling Agreement and any written service agreement, constitute the entire agreement between the parties. They supersede all prior representations, agreements, and understandings.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. No waiver of any term is effective unless made in writing.

Legacine may not assign any agreement to another party without the Client's written consent.

14. Changes to these terms

We may update these Terms and Conditions from time to time. The updated version will be published on this page with a revised date. Changes do not affect agreements already in force unless both parties agree in writing.
